2018 FACE OF AMERICA MODEL SEARCH TERMS AND CONDITIONS
Open call for face models for the 2018 Face of America Title. Deadline for submissions is December 21st, 2017.
Requirements for submission:
(a) No more than 1-2 Headshots per entry, the submitted photo(s) must have been taken within last 12 months.
(b) Must be 18 years or older to participate.
(e) It is free to submit to submit one to two photo(s) for consideration. If your photo is chosen there will be a non-refundable $25 processing fee.
ELIGIBILITY:
Participation constitutes full and unconditional agreement to, and acceptance of, these Official Rules. The Face Of America (FOA) Model Search is open to men and women who are legal residents of the United States, who are 18 years of age or older. Employees, officers, directors of F.O.A and Natural Beauty’s Playground (NBP) and Natural Beauty's Playground Cosmetics (NBPC) are not eligible to enter the contest. This contest is offered in the U.S. only and shall only be construed and evaluated according to U.S. law. Residents of states that prohibit such contests are ineligible.
HOW TO ENTER:
Online: Go to www.nbpgrd.com and complete the registration form. Provide all requested information in the required fields contained in the
entry form. Upload your photo entry. Deadline for all completed entries is December 31st, 2017. No photo entries will be accepted without filling out registration form and agreeing to terms and conditions and paying the processing fee. There is a non-refundable processing fee of $25 for all contestants.
GENERAL RULES OF CONTESTS:
To enter the Contest you must register online on or before December, 21st 2017. Contestants will be chosen by F.O.A officials and notified on or before December 21, 2018. The registration process must be completed and the $25 non-refundable processing fee must be paid on or before December 31st, 2017. Contestants will compete in an online voting process in which each vote costs one dollar, for the grand prize of $1000. The number of contestants to compete in each state and in the competition is determined by the level of participation and is at the sole discretion of the executives of F.O.A., NBP and NBP Cosmetics. As part of our talent awareness promotions we will be advocating the top ten finalists photo(s) to a three top talent and modeling agencies both nationally and internationally for their consideration. This does not guarantee representation.
The contestant with the most votes combined with the executive decision of F.O.A, will be announced on January 21st, 2018, and Titled 2018 Face of America. The winners image will also be promoted with one of N.B.P cosmetics products within the year of 2018. F.O.A. and its affiliate companies will choose which product model image will be displayed with. Prize(s) will be award by mail to contestants address provided on the entry form, within ninety (90) days after winning prize(s). By submitting a photograph you hereby grant to N.B.P, N.B.P.C, F.O.A and other users of www.nbpgrd.com a non exclusive, worldwide, license to the copyright of the photograph(s), and to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such content including without limitation distributing part or all of the site in any media formats through any media channels, and other Users may copy, print of display publicly available content outside of www.nbpgrd.com, including without limitation, via the Site or third party websites or publications, and you agree not to raise any claim or dispute based on any right to privacy for the entrants against to N.B.P, N.B.P.C, and F.O.A or any others based on your participation in the Contest. N.B.P, N.B.P.C, and F.O.A reserve the right to amend the Contest rules at any time. Entrant must be the owner of the photograph(s), the submitted photo(s) must have been taken within last 12 months, and have the right to submit the photograph(s) for consideration in the Contest. Entrant must own the copyright for the photograph(s), such as by providing the artistic impression for, and the taking of the photograph(s), or by acquiring an assignment of the copyright from another who provided the artistic impression for the photograph(s), such as the photographer. All rules, rule interpretations, disqualifications, prize awards, and all other aspects of the Contest will be decided by N.B.P, N.B.P.C, and F.O.A‘s judgment. The entrant indemnifies N.B.P, N.B.P.C, and F.O.A for any and all costs associated with a claim, suit, or threat of claim based on N.B.P,N.B.P.C, and Foam’s publication of any image entered in the Contest, including all legal costs. Businesses, individuals and/or organizations partnering with N.B.P, N.B.P.C, and F.O.A for any reason, including but not limited to Contest promotion, are the be considered “sponsors” with same rights and protections as N.B.P, N.B.P.C, and F.O.A’s under these rules.
WINNER NOTIFICATION:
The potential winner will be contacted by email, mail or phone. F.O.A will contact the potential winner in accordance with the information supplied on their Entry Form. If prize is returned undeliverable, potential winner forfeits prize. A copy of a valid ID will be required to be submitted before prize is awarded. Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address to [email protected]. If F.O.A is unable to communicate directly with a winner within three (3) days from initial attempted notification, F.O.A in their sole discretion may disqualify that winner and select an alternate runner up winner using the same winner selection method set forth above. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. In the event that the potential winner is disqualified for any reason, sponsors will award the applicable prize to an alternate winner runner up. Only two (2) alternate runner ups will be contacted, after which prize will remain un-rewarded. Upon verification of eligibility, the names and/or photographs of the Winner depicted in the winning Entry photographs will be posted on www.nbpgrd.com . The winner of the 2018 Face Of America model search will receive $1000, and titled the "2018 Face Of America." Prizes will be fulfilled approximately 4 - 12 weeks after the conclusion of the contest.
Release and Limitations of Liability
By participating in the Contest, entrants agree to all terms and condition and requirements, release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with Contest, and each of their respective officers, directors, employees, shareholder, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP),
network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellar tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest: (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, including, without limitation, errors that may occur in the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participants in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorneys fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
MISCELLANEOUS:
All federal, state and local laws apply, N.B.P, N.B.P.C, and F.O.A shall be entitled to interpret these rules as needed – including but not limited to rules regarding entries, selection of winners, deadlines, restrictions on awards, and eligibility – and all of their decisions are final. By entering,
Entrants agree to these Official Rules. Authorized sponsors reserves the right to cancel, terminate or suspend this Contest or any part of this Contest at any time and for any reason, including but not limited to any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, corruption or impairment of the security, administration, fairness and/or operation of the Contest, as determined by authorized sponsors in their sole discretion. Authorized sponsors retain the right to select the Winners in accordance with any criteria deemed appropriate at the sole discretion of the authorized sponsors, including the previously announced selection criteria from among all non-suspect eligible entries received at the time of the Contest termination. Sponsors are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, even if the failures or disruptions are due to Sponsor errors, or for entries that for any reason are not received by authorized sponsors by other electronically device as a result of participation in this Contest or downloading of any software or materials.
Authorized sponsors reserve the right to correct typographical or clerical errors in any Contest-related materials. No more than the stated number of awards will be available. In the event production, technical, seeding, programming or any other reasons causes more than the stated number of awards as set forth in theses Official Rules to be available and/or claimed, Sponsors reserve the right to provide only the stated number of awards by selecting the Winners using any criteria deemed appropriate at the sole discretion of the Sponsor. N.B.P, N.B.P.C, and F.O.A will NOT be responsible for the inability to select winners because of postal failure, equipment failure, or data storage failure. Sponsors reserve the right to prohibit any Entrant from participating in the Contest if, at their discretion, Sponsors find such Entrant to be tampering with the entry process or the operation of the Contest, or if such Entrant repeatedly shows a disregard for, or attempts to circumvent, these Rules, or acts;
(a) in a manner Sponsors determine to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other Entrant or Sponsors;
or (c) in any other disruptive manner as determined by the Sponsor. Any person attempting to defraud or tamper with this Contest in any way will be ineligible to participate or receive an award and may be prosecuted to the full extent of the law. Any failure by the Sponsors to enforce any of these Rules shall not constitute a waiver of such Rules. Entrants agree to release N.B.P, N.B.P.C, F.O.A and the Contest Sponsors from any and all liability related to this Contest and the use of the Entry photograph(s).
DISPUTES:
By entering the Contest, Entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any awards shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys’ fee; and (c) under no circumstance will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any all rights to have damages and any and all rights to have damages multiplied or otherwise increased and any other interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Maryland. Any legal proceedings arising out of this Contest or relating to these rules shall be instituted only in the federal or state courts located in Maryland and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and to be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
