This Agreement ("Agreement") is made between the New Native America organization and the participant for the Global Harmony Lens: Multiracial Cultural Awareness Photo Contest. By participating in the Contest, the Participant agrees to be bound by the terms and conditions outlined in this Agreement.
- Eligibility: a) The Contest is free and is open to individuals aged 18 years or older, regardless of nationality or residency. b) Participants must submit a photograph that represents their multiracial heritage. c) Employees, volunteers, and immediate family members of the Organization are not eligible to participate.
- Contest Duration: The Contest will begin on December 7th, 2023, and end on February 21st, 2024. All submissions must be received by the Organization by February 1st, 2024.
- Submission Requirements: a) The photo must relate to the theme of the contest, which is promoting multiracial cultural awareness. B) The photo(s) may be taken by amateurs and/or professional photographer. c) Each Participant may submit one to two photographs for consideration. d) The photo must not infringe upon any copyrights, trademarks, or other intellectual property rights of any third party.
- Prizes: I acknowledge that prizes will be awarded as specified in the contest details for the "Global Harmony Lens: Multiracial Cultural Awareness Photo Contest." I understand that prize details are subject to change at the discretion of N.N.A.
- First Prize: $500
- Second Prize: $350
- Third Prize: $150
- General Rules Of Contests: Enter one to two photos. Contestants will compete in an online voting process in which each vote costs one dollar, which is non-refundable. The number of votes received will not be released to contestants and others outside this contest. Votes are exclusively maintained and controlled by the executives of The Global Harmony Lens: Multiracial Cultural Awareness Photo Contest. The number of contestants to compete in this contest is determined by the level of participation and is at the sole discretion of the executives of the Global Harmony Lens: Multiracial Cultural Awareness Photo Contest. Avoid where prohibited by law. .
- By submitting my photo, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined in this agreement for the "Global Harmony Lens: Multiracial Cultural Awareness Photo Contest."
- By submitting a photograph to the Contest, the Participant warrants that they are the sole owner of the photograph and hold all necessary rights to grant the N.N.A. a non-exclusive, worldwide, royalty-free license to reproduce, distribute, and publicly display the photograph for promotional and marketing purposes related to the Contest. b) The Participant retains full copyright ownership of their photograph. I grant New Native Americans a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute my photo for promotional purposes related to the "Global Harmony Lens: Multiracial Cultural Awareness Photo Contest," including online galleries, social media, and promotional materials.
- Void where Prohibited: The Contest is void where prohibited or restricted by law. Participants are responsible for ensuring their eligibility to participate based on their local laws and regulations.
- Indemnification: The Participant agrees to indemnify and hold the Organization harmless from any claims, damages, losses, or expenses arising out of or in connection with their participation in the Contest.
- Winner Notification :
The potential winner will be contacted by email. N.N.A. will contact the potential winner by the information supplied on their Entry Form. If the prize is returned undeliverable, the potential winner forfeits the prize. A copy of a valid ID will be required to be submitted before the prize is awarded. Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address, which should be sent to [email protected]. If N.N.A is unable to communicate directly with a winner within three (3) days from the initial attempted notification, N.N.A., in their sole discretion, may disqualify that winner and select an alternate runner-up winner using the same winner selection method set forth above. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. If the potential winner is disqualified for any reason, sponsors will award the applicable prize to an alternate runner-up. Only two (2) alternate runners-up will be contacted, after which the prize will remain unrewarded. Upon verification of eligibility, the names and/or photographs of the Winner depicted in the winning Entry photographs will be posted on www.nbpgrd.com. The winners of the cash prizes will be fulfilled approximately 4 - 12 weeks after the conclusion of the contest. - Release and Limitation of Liability: I understand and agree that the New Native Americans organization shall not be held liable for any damages, losses, or injuries arising from my participation in the "Global Harmony Lens: Multiracial Cultural Awareness Photo Contest" or the use of my photo in connection with the contest. The Organization shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the Contest, including but not limited to any errors, technical malfunctions, or unauthorized access to Participant information. By participating in the Contest, entrants agree to all terms and conditions and requirements, release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), and/or discontinued availability of promotional avenues promoted in the contest such as billboards, Reuters, advertisements within the United States, and other media promotions not available within the year of the winner's reign, network, server, wireless service provider, or other connections, availability or accessibility, or miscommunications or failed computer, satellite, telephone, cellular tower, or cable transmissions, lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or difficulties; (b) unauthorized human intervention in the Contest: (c) mechanical, network, electronic, computer, human, printing, or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, including, without limitation, errors that may occur in the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloads, or in any Contest-related materials; or (f) injury, death, losses, or damages of any kind, to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or acceptance, receipt, or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Entrant be entitled to receive attorney's fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- Modification and Termination: The Organization reserves the right to modify, suspend, or terminate the Contest at any time, with or without notice, for any reason.

- Publicity Release: By participating in the Contest, the Contestant grants the Organization the right to use their name, likeness, photograph, and biographical information for promotional purposes related to the Contest and the Organization, without further compensation or notice, except where prohibited by law.
- Governing Law and Jurisdiction: This Agreement shall be governed by and construed by the laws of Maryland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Maryland.
- Agreement Acceptance: By submitting my photo (s), I acknowledge that I have read, understood, and agreed to the terms and conditions outlined in this agreement for the "Global Harmony Lens: Multiracial Cultural Awareness Photo Contest."
